
Module 1 introduces the HCBS Settings Rule, explains the rights protected by the rule, identifies where the rule applies, and details your role as a DCW in upholding the rule. After taking module 1, please take HCBS Settings Rule: Module 2—Rights Modification. Module 2 defines rights modifications, identifies criteria that must be documented, explains the process and timelines, and discusses dignity of risk.
By the end of module 1, you will be able to:
• Recall the background and purpose of the Home- and Community-Based Services (HCBS) Settings Rule;
• Identify HCBS Settings Rule criteria as well as affected waivers and settings;
• Recognize your responsibility to uphold the HCBS Settings Rule; and
• Explain what the rights protected by the HCBS Settings Rule mean.
By the end of module 2, you will be able to:
• Identify rights modifications;
• Identify criteria that must be documented;
• Follow the rights modification process;
• Explain dignity of risk and the individual’s option to not consent to a rights modification; and
• Use resources to address common misconceptions.
